Holiday Booking Contract 2012
Tates coaches take every care that you will have an enjoyable carefree holiday, but in your own interest you are advised to read the following conditions which set out the respective rights & liabilities of yourself & the company. Upon signing the booking form & receiving confirmation you accept these conditions.
YOUR HOLIDAY PRICE
Holiday prices include coach travel, ferries, VAT., accommodation & meals only as specified in the holiday description. Coffee & refreshments en-route, lunches on day excursions are not included unless specified.
We guarantee that your holiday price will not be subject to surcharges except for those resulting from action beyond our control. Continental holidays may also incur surcharges should the exchange rate change from those shown in the holiday description.
RESERVATIONS
A non-refundable deposit of £50.00 per person to be paid at the time of making the booking. The balance is to be paid no later than 6 weeks prior to the departure date. Insurance premiums should be paid at the time of making the reservation.
IF YOU CANCEL YOUR HOLIDAY
You must do so in writing to Tates Coaches. As this incurs administrative costs we will retain your deposit. If cancelled within 42 days the following charges will apply.
42-28 Days | 30% of total holiday cost |
27-14 Days | 45% of total holiday cost |
13-7 Days | 60% of total holiday cost |
Within 7 Days | 100% of total holiday cost |
COMPLAINTS
If you have a complaint during your holiday please notify our driver/courier immediately, who will do his/her best to rectify the problem at source. If this is not possible please send details in writing within 14 days of your return from the holiday. The company may not be able to examine any claim if the period has elapsed.
STATUTORY AUTHORITIES
This brochure is issued to conform to the legislation of the national & international bodies of those countries it will operate in. The company reserves the right to modify the tours to conform with requests from the relevant authorities.
ON A HOLIDAY YOU MAY NOT
1. Bring a pet or any other animal (except guide dogs by arrangement)
2. Play a radio or audio equipment on the coach.
3. Engage in any activity likely to cause nuisance to other passengers.
4. Smoke on the coach
CONDITIONS OF CARRIAGE
Tates Coaches accepts responsibility for those arrangements for your holiday which are wholly within our control & therefore accepts liability to clients for the negligence of our servants or employees. We make every effort to ensure proper arrangements have been made for all holidays advertised in the brochure & that suppliers of the services which you will enjoy during your holiday are efficient and reputable. However, we do not have direct control over the provision of such services by those suppliers & so cannot accept liability for any loss arising from actions or omissions of such suppliers who are not our servants or agents.
Luggage must be restricted to one medium size suitcase (15 kilos) per person. We reserve the right to refuse to carry overweight luggage. Whilst every care will be taken with passenger's possessions, the company cannot accept liability for luggage or personal items left in the coach.
Travel Insurance
A Special Holiday Travel Insurance Scheme is available for all passengers travelling on our holidays which is arranged with ETI – International Travel Protection (the UK branch of Europäische Reiseverscherung AG) who are Licensed by the Bundesanstalt für Finanzdienstleistungsaufsicht (BAFIN – www.bafin.de) and approved by the Financial Services Authority (FSA – www.fsa.gov.uk) to undertake insurance business in the UK.
Should you wish to take advantage of our Holiday Travel Insurance please include the appropriate premium when booking your holiday.
DEMANDS AND NEEDS
This insurance policy will suit the Demands and Needs of an individual or group(where applicable) who have no excluded pre-existing medical conditions, are travelling in countries included within the policy terms and who wish to insure themselves against unforeseen events detailed in the cover section below. Subject to the terms, conditions and maximum specified claim limits.

We summarise below the details of the insurance cover provided which also includes SPECIALTY ASSISTANCE LTD - 24-hour emergency service. The following is a brief summary of the cover available. Full details of Cover, Policy Warranties and Exclusions will be forwarded with your confirmation of booking. In any event you may ask for a specimen copy of the Policy Wording before booking should you wish to examine this in advance.

POLICY EXCESS
Cancellation, Curtailment, Holiday Abandonment and Loss of Deposit for holidays up to and including 3 days NIL. For holidays over 3 days Loss of Deposit excess £15.00 each and every loss. For holidays over 3 days excess £50.00 each and every loss for Cancellation, Curtailment and Holiday Abandonment. Medical and Other Expenses, Additional Travelling Expenses — United Kingdom, Personal Property and Money excess £30.00 each and every incident per Insured Person
IMPORTANT – HEALTH CONDITIONS APPLYING TO ALL TRAVEL DESTINATIONS
If you are travelling in England, Scotland, Wales, Northern Ireland and can answer NO to questions 1 -3 and YES to 4 immediately below, it will not be necessary for you to complete a Self Declaring Medical Form. The Standard Policy Terms, Conditions and Exclusions shall apply.
Applying to all areas
It is a condition that at the time of taking out this policy and between that time and your departure you must comply with each of the following:
- You are not aware of any reason why the trip should be cancelled or cut short
- You are not traveling:
- against the advice of a medical practitioner
- for the purpose of obtaining medical treatment, or
- if you have been given a terminal prognosis
- You are not receiving or awaiting treatment for an illness or injury as a hospital day case or in-patient, as any claim arising from this injury or treatment will not be covered.
- If you are on medication at the time of your travel your medical condition is stable and well controlled.
In addition if you are traveling outside England, Scotland, Wales and Northern Ireland, the following additional conditions will apply:
You must notify the Issuer of this policy immediately of any of the conditions listed below arising between the date the policy is issued and the time of departure of the trip. We must be informed of any fact, which is likely to influence us in the acceptance, assessment or continuance of this insurance. Failure to do so may invalidate this insurance, leaving you with no right to make a claim.
- if you have received medical treatment as a hospital day case, in-patient or out-patient during the six months prior to the booking of the trip, you must obtain from a medical practitioner at your cost confirmation that you will be fit enough to take the trip.
- if you are undergoing medical treatment as a hospital out-patient at the date the final balance of the trip is due to be paid, you must obtain at your cost a certificate of fitness confirming your ability to travel.
The Policy contains the following General Exclusions:
YOU ARE NOT COVERED for anything caused directly or indirectly by you suffering from stress, anxiety or depression unless it has been investigated and diagnosed as such by a Consultant specialising in the relevant field, who must confirm in writing at your cost that you are fit enough to take this trip.
Please note our Holiday Travel Insurance Scheme is only available to United Kingdom Residents.
We are an Appointed Representative of ITC Compliance Limited who are authorised and regulated by the Financial Services Authority.

In accordance with "The Package Travel, Package Tours Regulations 1992" all passengers booking with Tates Coaches Ltd are fully Insured for the initial deposit and subsequently the balance of all monies paid to us, including repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Tates Coaches Ltd.
A certificate detailing this cover will be given to each and every passenger as evidence of cover. Please ensure that you have been given the appropriate certificate(s) at the time of booking.
This insurance has been arranged by Towergate Chapman Stevens through HCCI International Insurance Company PLC.
